General Terms and Conditions of Sale


Les présentes conditions générales de vente sont conclues d’une part par la société COSIFLY au capital social de € 10 000 ,- dont le siège social est situé à 155, boulevard Malesherbes – 75017 PARIS, immatriculée au Registre du Commerce et des Sociétés de Paris, sous le numéro 852 471 259 ci-après dénommée « le Vendeur » et gérant le site https://www.cosifly.com et, d’autre part, par toute personne physique ou morale souhaitant procéder à un achat via le site internet site https://www.cosifly.com dénommée ci-après  » le client « .


Article 1. Purpose

The present general conditions of sale aim at defining the contractual relations between COSIFLY and the customer and the conditions applicable to any purchase carried out by the means of the Internet site https://www.cosifly.com. The acquisition of a product through this site implies an acceptance without reserve by the customer of these general conditions of sale which the customer acknowledges having read prior to his order. Before any transaction, the customer declares on the one hand that the purchase of products on the site https://www.cosifly.com is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under these general conditions of sale.

The company COSIFLY retains the possibility to modify at any time these general conditions of sale, in order to respect any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the website https://www.cosifly.com of the company COSIFLY, within the limits of available stocks. The company COSIFLY reserves the right to modify at any time the range of products. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but do not commit the Seller.

Article 3. Tariffs

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of products. The company COSIFLY reserves the right to change its prices at any time, however, it is understood that the price listed in the catalog on the day of the order will be applicable to the customer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In metropolitan France and within the E.U. (including Switzerland, the United Kingdom and Norway), for any order greater than or equal to 250 euros including tax, shipping costs are offered; for any order less than 250 euros including tax, shipping costs are charged to the customer depending on the destination and the shipping method chosen.

Article 4. Order and payment terms

Before placing an order, the customer must create an account on the site https://www.cosifly.com. The account creation section is accessible directly from the side menu bar. At each visit, the customer, if he wishes to order or consult his account (status of orders, profile...), will have to identify himself using this information. The company COSIFLY offers the customer to order and pay for products by credit card (secure payment) in several stages:

- The customer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the customer, as well as the name of the carrier.

- The next step is to check all the information, read and accept the present general terms and conditions of sale by ticking the corresponding box, and then to validate the order by clicking on the "Confirm my order" button.

- Finally, the customer is redirected to the secure MONETICO (CIC) interface in order to enter his personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the customer may demand the cancellation of the payment by card, and the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven and carried out fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. The holder shall not be liable for any costs incurred in returning the sums.

Les règlements par Paypal (CB, MASTERCARD, VISA, AMERICAN EXPRESS) sont admis sur le site https://www.cosifly.com et s’effectuent alors par l’intermédiaire du partenaire en question et selon ses propres conditions générales de vente et d’utilisation de ses services.
Le choix de ce paiement vaut acceptation tacite des conditions générales de vente et d’utilisation du Partenaire.

The confirmation of an order implies acceptance of these terms of sale, the recognition of having perfect knowledge of them and the renunciation to take advantage of its own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the customer has an e-mail address and if he has given it on his order form, the company COSIFLY will send him by e-mail the confirmation of the registration of his order after acceptance of his payment.

Article 5. Availability of products

The available products appear on the site, accompanied by the mention "available". In case of unavailability of the ordered product after the validation of the order, the customer will be immediately informed. The seller will offer a refund if the amount has already been debited or will inform the customer of the restocking period (depending on the seller's suppliers).

Article 6. Withdrawal

 Si le client change d’avis, il peut simplement retourner le produit, non porté, non détérioré, dans son emballage d’origine, dans les 14 jours qui suivent sa commande. Passé ce délai il est impossible d’effectuer un retour. Les frais de retour sont à la charge du client.

Tous les produits fournis par la société COSIFLY bénéficient de la garantie légale prévue par les articles 1641 et suivants du Code civil. En cas de non-conformité d’un produit vendu, il pourra être retourné à la société COSIFLY qui le reprendra, l’échangera ou le remboursera. Toutes les réclamations, demandes d’échange ou de remboursement doivent s’effectuer par voie postale à l’adresse suivante : COSIFLY – 155, Bld Malesherbes – 75017 PARIS.

Le remboursement ou le remplacement se fera dans un délai de 14 jours à réception du produit retourné.

Article 7. Delivery and customs charges

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Shipments are made, according to the choice of the customer, by one of the following carriers: GLS, CHRONO 13 or DHL. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the customer reimbursed. The company COSIFLY may provide the customer with the tracking number of his package by e-mail. The customer is delivered to his home by the chosen carrier. In case of absence of the customer, he will receive a notice of passage or a sms from the carrier, in order to reschedule a delivery date. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

In the event of delivery of a Product outside the territory of the European Union and in the French Overseas Departments and Territories, the Customer declares himself to be the importer of the Product and accepts that, in such a case, the Seller may be unable to provide him with accurate information on the total amount of costs relating to customs duties and formalities or import taxes applicable in the country where delivery of the Product is requested.

Par définition les commandes expédiées en France ne sont pas touchées par les frais de douane.
Les commandes expédiées en zone UE ne sont pas touchées non plus par les frais de douane. Le mécanisme de TVA intracommunautaire s’applique.
Pour tous les autres pays, des frais de douane peuvent être appliqués, selon la législation locale  et les accords avec la France et l’Union Européenne en vigueur. Ces législations et ces accords peuvent évoluer sans préavis, et Cosifly ne peut pas les référencer en permanence. C’est au moment de l’arrivée sur le territoire concerné que les frais de douanes sont calculés et appliqués.
Pour ces pays hors UE, le transporteur est chargé d’appliquer les règles de dédouanement en vigueur. Concrètement cela signifie que le client peut être contacté par le transporteur afin de régler la taxe de dédouanement préalablement à la livraison du colis.
Si, passé un certain délai, ces frais ne sont pas réglés, les marchandises sont saisies par les services douaniers. Cosifly ne peut en aucun cas être tenu responsable d’une non-livraison en cas de blocage en douane. De même, dans ce cas particulier, aucune demande d’annulation de commande ou de remboursement ne pourra être honorée.

Any tax not indicated during the Order process may be charged to the Customer by the authorities of the country concerned, in accordance with the applicable legislation.

Article 8. Guarantee

All products supplied by the company COSIFLY benefit from the legal guarantee provided by Articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to the company COSIFLY which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by mail to the following address COSIFLY - 155, Bld Malesherbes - 75017 PARIS, within thirty days after delivery.

Article 9. Liability

The company COSIFLY in the process of distance selling, is bound only by an obligation of means. Its responsibility cannot be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems. The seller shall not be liable in the event of non-performance of the contract due to a case of force majeure (strike, flood, fire, natural disaster or any other exceptional situation)

Article 10. Intellectual Property

All the elements of the site https://www.cosifly.com are and remain the intellectual and exclusive property of the company COSIFLY. Nobody is authorized to reproduce, exploit, or use in any capacity whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text. Moreover, the name, the brand, the logo and the drawings are registered. The initial model named LE COSIFLY is also the subject of a patent application.

Article 11. Personal data

The company COSIFLY undertakes to preserve the confidentiality of information provided by the customer, which it would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of the law n° 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Settlement of disputes

The present conditions of remote sale are subjected to the French law. For all disputes or litigation, the competent court will be that of PARIS.
